Agrico is committed to protecting the privacy of its clients
and we have taken measures to ensure that the information we
gather from you will be secure and confidential. While information
is the foundation of our ability to provide superior products
and service, keeping customer information secure, and using
it only as our customers would want us to, is a top priority
for all of us at Agrico.
As part of this commitment, and in compliance with the Personal
Information Protection and Electronic Documents Act (PIPEDA),
enacted January 2004 by the federal government of Canada,
Agrico has established a Privacy Policy that outlines procedures
for obtaining, transfering and using personal information, specifically
over electronic media (i.e. Agrico website and e-mail). The
details of this policy are as follows:
Types of information collected
For each visitor to our web page, our web server
automatically attempts to resolve the visitor's domain name. In
addition, we may collect the e-mail addresses of those who communicate
with us via e-mail, and record information volunteered by
the consumer, such as survey results and/or site registrations.
Periodically, we may also collect aggregate information on what
pages consumers access or visit.
With respect to Ad Servers: We do not partner
with or have special relationships with any ad server companies.
What the information is used for
The information we collect pertaining to website
traffic is used only for internal review or to improve the content
of our Web page and is not shared with other organizations for commercial
purposes.
Agrico will limit the collection and use of
personal information (whether it is requested or voluntarily supplied)
to the minimum we require to deliver top quality products and service
to our customers and to meet the needs you ask of us. Any on-line
requests for personal information (i.e. contact information, personal
identification, financial information, transactional information)
will be accompanied by a statement outlining the intended purpose
for gathering the information and, where appropriate, a request
for authorization.
Confidentiality and Security of Personal
Information
Agrico maintains physical, electronic, and procedural
safeguards to protect your personal information from unauthorized
access, alteration, or premature destruction.
As a general rule, Agrico does not disclose
personal information about our clients or former clients to anyone.
Our policy is to disclose personal information about our clients
only with their express authorization. However, to the extent permitted
by law and any applicable provincial code of Professional Conduct,
certain nonpublic information about you may be disclosed in the
following situations:
- To comply with a validly issued and enforceable
subpoena or summons;
- In the course of a review of our company's
practices under the authorization of an accredited provincial,
federal or other third-party auditing firm;
- In the event of a prospective purchase, sale,
or merger, provided that we take appropriate precautions (for
example, through a written confidentiality agreement) so the prospective
purchaser or merger partner does not disclose information obtained
in the course of the review;
- As a part of any actual or threatened legal
proceedings or alternative dispute resolution proceedings either
initiated by or against us, provided we disclose only the information
necessary to file, pursue, or defend against the lawsuit and take
reasonable precautions to ensure that the information disclosed
does not become a matter of public record;
- To provide information to affiliates of the
firm and nonaffiliated third parties who perform services or functions
for us in conjunction with our services to you, but only if we
have a contractual agreement with the other party that prohibits
them from disclosing or using the information other than for the
purposes for which it was disclosed.
Except as otherwise described above, we restrict
access to nonpublic personal information about you to authorized
and trained employees and other necessary parties who require the
information to provide requested services to you. Their right to
further disclose and use the information is governed by the policies
of our company, applicable law, and applicable confidentiality agreements.
Employees who violate our Privacy Policy will be subject to our
normal disciplinary process.
Links to other websites
Our website contains links to the websites of other organizations.
Although our intention is purely to provide access to reputable
and relevant sources of information, Agrico does not actively monitor
these sites or make any claims with regard to the privacy policies
(or lack thereof) they have in place. Users wishing to follow these
links may do so at their own risk.
Changes to privacy policy
From time to time, we may use customer information
for new, unanticipated uses not previously disclosed in our privacy
notice. If our information practices change at some time in the
future we will update the privacy policy on our Web site to notify
you of these changes and provide you with the ability to opt out
of these new uses. If you are concerned about how your information
is used, please check back at our Web site periodically or contact
us at the phone number above.
Access to personal information (How to find
out what information we have about you)
We will attempt to keep customer files complete, up to date, and
accurate. We will tell our customers how and where to conveniently
access their account information (except when prohibited by law)
and how to notify us about errors, which we will promptly correct
(if possible).
All requests and notifications applicable
to Agrico Canada Ltd must be made in writing. Please be sure
to include your:
- Name;
- Address;
- Phone number (where you can be reached during
business hours);
- Account number;
- The best time of day for us to call you;
and
- If you are requesting information, specify
the information you are interested in.
On your request, Agrico will generally provide
you with access to personal information we have on file about you.
However, in some cases, we may not be
able to provide you with all the information we have about you.
This would occur if provision of the information could lead to disclosure
of another individual's personal information, where laws or regulations
prevent disclosure, or where it would simply be too costly to provide
the information. If we are not able to disclose some or all of your
personal information to you, we will advise you of the reason.
